The Appleton Public Library and Eminent Domain

The article answers the following question:   Could you please explain eminent domain and how it affects Trinity Lutheran Church and the proposed new Appleton library site?

Eminent domain.  Right of government to take private land for a public purpose.

New library location:  On a bluff overlooking the Fox River, a site currently occupied by Trinity Lutheran Church and Fox Banquets and Rivertyme Catering.

Timeline:
  • August 20, 2014.  Appleton City Council declares that the properties are necessary for a public purpose.
  • City hires appraiser to determine value of properties
  • Appraisals provided to property owners.
  • Property owners have 60 days to get their own appraisals.
  • City of Appleton prepares relocation and compensation plan
  • City and property owners enter into negotiations..
