The lawsuit, filed April 25 in Polk County District Court, asserts that several records the Register sought under Iowa's open-records law are subject to "executive privilege," a legal doctrine protecting a government executive's right to obtain candid advice from advisers without fear of public disclosure.
While federal courts have recognized executive privilege for the American presidency, Iowa's open-record law does not include an executive privilege exemption. [emphasis added]
Reynolds spokesman Mason Mauro said in a press release announcing the lawsuit that protecting executive privilege is in the "public interest."
