Although Donald Trump has not yet started his second term, he and his allies keep teasing the possibility of securing a third one in 2028, a threat that some Democrats are taking quite seriously. The 22nd Amendment has been widely assumed to allow each president no more than two terms in office. But some legal scholars have identified a potential workaround that a president with dictatorial ambitions—that is, someone like Donald Trump—might seek to exploit in pursuit of a third term. Dahlia Lithwick and Mark Joseph Stern discussed this theory on a recent episode of Amicus, and their conversation prompted low-key social media debate as well as a large dose of skepticism. On this week’s Slate Plus bonus episode, they addressed listeners’ questions and objections. An excerpt of their conversation, below, has been edited and condensed for clarity.
