South Dakota confirmed its second highly pathogenic avian influenza outbreak in August 2026, affecting a commercial breeder operation with 29,700 birds in Edmunds County on August 21, marking the 11th commercial poultry flock impacted by HPAI in the state this year. 

• A commercial breeder operation in Edmunds County, South Dakota was confirmed with HPAI on August 21, 2026, affecting 29,700 birds. 

• This is the second HPAI outbreak in South Dakota within nine days, following a case that killed 74,900 commercial meat turkeys in Beadle County. 

• South Dakota has now experienced 11 confirmed commercial poultry flock cases of HPAI in 2026, with one additional backyard flock case. 

• The last previous commercial case in the US occurred on July 13 in Cache County, Utah, affecting 275,100 table egg layer pullets. 

• Backyard flock infections do not impact international poultry trade under World Organisation for Animal Health (WOAH) rules.

Ron Wyden of Oregon said: “RFK’s platform is built on lies and grifts that leave a trail of dead children in their wake. There are consequences for lying to Congress.” 

The Guardian’s reporting was based on letters that were obtained – by this news outlet and the Associated Press – following a Freedom of Information Act lawsuit. 

Wyden said in a statement to the Guardian that he would be pressing Republican colleagues, who currently control the Senate, to issue a criminal referral of Kennedy to the Department of Justice for a criminal investigation. “And when Democrats retake the majority in the Senate, RFK will be at the top of the list of Trump officials the finance committee will hold accountable for endangering American families,” he said. Wyden currently serves as the top Democrat on the finance committee.  [emphasis added]

Also on Thursday, the government watchdog group American Oversight sent a letter to the justice department requesting that it immediately open an investigation into whether Kennedy violated the law by making false statements to Congress.
