Following the confirmed presence of HPAI in the flock in British Columbia, CFIA ordered that the ostriches be depopulated. However, the owners of the birds, Universal Ostrich Farm, resisted the order, eventually taking its case to the Federal Court of Appeals to question the order.
During July court proceedings, the farm operators argues that HPAI had not been detected on the farm for months, and that the birds should be allowed to live.
Universal Ostrich Farm lost its appeals with both the Federal Court of Appeals, and the Supreme Court of Canada, with the latter ruling occurring on November 6.
One day later, CFIA announced that the depopulation of up to 400 ostriches had been completed.
