Now that both Bensen and Waukesha County DA Sue Opper have sent the charges back, the commission has the option to refer them to Attorney General Josh Kaul, who has received other referrals linked to the alleged scheme.
Bensen declined to provide the letter he sent to the Ethics Commission explaining why he decided not to pursue allegations Brandtjen facilitated donations to evade campaign finance limits and bolster a 2022 primary challenger of Assembly Speaker Robin Vos, R-Rochester. WisPolitics has filed an open records request seeking the document.
